PROPOSED ORDINANCE (By Petition)

to Amend Chapter 1167.02 of the Codified Ordinances of the City of Salem, Ohio

Chapter 1167 regulates single family neighborhoods zoned RS-2 and RS-3 in which many homes suitable for a B&B are located.

SECTION 1167.02 CONDITIONAL USES, reads:

(a) Hospital, nursing home, and educational, philanthropic or religious institution on site of not less than five acres, provided not more than fifty percent (50%) of the site area may be occupied by buildings, and provided further that the building shall be set back from all required yard lines an additional foot for each foot of building height.

(b) Nursery, prekindergarten, kindergarten, play, special and other private schools.

(c)  Private recreational facility on a site of not less than five acres and where buildings do not occupy more than ten percent (10%) of the site area.

(d)  Public building erected by any governmental agency.

(e)  Parking lot located within 200 feet of a “C” or “M” district. (Ord. 711103-112. Passed 5-1-73.)

VOTE YES TO AMEND BY ADDING TO SECTION 1167.02 CONDITIONAL USES, THE FOLLOWING QUOTED PARAGRAPH:

“(f) Bed and Breakfast Home.”






City of Salem ordinances do not currently permit B&Bs in any single family neighborhoods. In most municipalities, B&Bs quietly coexist with residential housing. They usually remain the owner's home but accept guests for a fee. As their name implies, breakfast is included in the cost of the stay.
 
 
All of the uses listed from (a) to (e) are part of the current City of Salem ordinance governing single family neighborhoods zoned RS-2 and RS-3.
 
 
The City has many different categories of residential housing. Each has distinct requirements for set back and lot size. The zones include RA, RD, RS-2, RS-3, RS-1 and RS-1A. The proposed ordinance covers only RS-2 and RS-3 areas because they are both governed by Section 1167 of the code. 

Voting YES on November 2 will add B&B Home to the other conditional uses in RS-2 and RS-3 zones. A conditional use permit would still have to be granted on a case by case basis before someone could operate a B&B.
